Snugzi Terms of Service

Please read all of the following rules and guidelines

For the purpose of the rules, understand that Snugzi refers to the world and all the species under that umbrella, not solely the Snugzi species.

By joining and participating in our community, you agree to adhere to the Terms of Service as well as our rules and guidelines throughout our platforms.
You must be at least 16 years of age to create an account and join the community. There are no exceptions, if you are under 16 you cannot contribute or join the species.
Users are required to have a Snugzi site account in order to own a Snugzi, they are not required to join the Toyhouse World or the Discord.
Hate speech, homophobia, hateful behaviour, racism, bigotry, slurs etc. will NOT be permitted, violating this rule results in an instant ban.
No scamming or attempting to circumvent rules. This includes but is not limited to, art theft, copying, or tracing. Colour picking is only allowed with permission from the original artist. Attempting to exploit loopholes or test staff limits is prohibited, users abusing loopholes may be warned or banned.
AI art is not allowed to be posted on any Snugzi platform (Website, Discord, Toyhouse and others). Discussions of using Generative, Diffusion, or any image generating AI for art are not tolerated.
Harassment of any kind is not permitted. Harassing some for creating characters with traits similar to Snugzi or associated species within the Snugzi world, if you have concerns someone is stealing or copying from the species please bring it to a staff member.
Be respectful to other users and staff. Some examples include: Bullying, hostility, victimisation, and passive-aggressive behaviour is not allowed. If you have an issue with another user, contact staff. If you have an issue with staff, contact an owner. Be respectful to others at all times, we have a no-tolerance policy for disrespect or hate. Conduct yourself politely, kindly, and in good faith with others.
Users should not take matters into their own hands or attempt to resolve issues independently. All concerns, disputes, or grievances within the community should be promptly reported to a staff member for proper handling and resolution. This ensures that everyone involved receives fair and consistent treatment, and maintains a respectful environment.
Staff members reserve the right to enforce these rules with warnings or bans, depending on what is appropriate. Members who continue to impact the community negatively will be removed.

Breaching Terms of Service and/or Rules

In the event that the Terms of Service and/or Rules are broken and disciplinary action is necessary, it will be carried out fairly and in accordance with established guidelines. The community disciplinary action strike system is used as follows, breaking a minor rule will result in one or more strikes. On the third strike you will be removed from both the site and server without further appeal. In special cases, staff reserve the right to terminate your account and access to the server even if you do not have three strikes.

Offense System:

Snugzi staff uses a THREE Verbal Warnings and TWO Official Warning system to moderate. Three Verbal Warnings will result in one Official Warning, and 2 Official Warnings result in a ban from the species. Small Verbal Warnings are not logged but repeated offenses will be. (For example: Requesting multiple claims without a purpose will result in a Verbal Warning, if you continue requesting claims you will receive an Official Warning. If it continues from there you can receive a ban for spamming.)

If staff feels its best to just outright give an Official Warning or Ban it will be discussed among staff and issued accordingly. (This will only occur for serious offenses.)

Verbal Warning Offenses:

Spamming/Ad reposting
Disrespect towards members or staff
Breaking the rules pinned in the Discord
Stirring/Creating drama
Mini-Modding
Ranting, venting, discussing drama, etc.
And other small offenses

Official Warning Offenses:

Repeated spamming/Spamming to an intense degree
Persistent disrespect/negativity towards staff/members
Loopholing rules
Tracing/HEAVY Referencing artwork or characters
Claiming unofficial designs as an Eternia species
Backing out of adopts from staff or members
Creating false claims, reports, tickets, etc.
Anything violating our rules severely
Other things staff may notice

Bannable Offenses:

Any slurs, derogatory terms, hate speech, etc.
Scamming, ghosting commissioners, theft
Harassment, stalking, abuse
Sharing hateful, harmful media
Anything else staff feels is bannable

If there is an ongoing issue with another user please contact staff via tickets in our Discord.

Rights and content:

Snugzi are a closed species created and owned by Keamuu with designs and inspirations from various users as credited. Keamuu and any persons identified by Keamuu retain full rights to the species, idea and initial designs. By uploading, submitting and or creating art to our site, you retain ownership of your content, but you grant Snugzi the right to use and display it as needed. We do not sell, distribute or use any designs without explicit permission from the original artist.

Closed species designs may not be shared or posted without an official approved MYO (Make Your Own) obtainable for free through activities on the Snugzi website. Unofficial designs may not be shared within the species, sold/traded, or used for events; the open species within the Snugzi world (Pompi) may be freely discussed and designed but must be uploaded to the Snugzi website masterlist.

All designs and Customs must be uploaded with a relevance MYO item, you may use your MYO slot to create and sell custom commissions for existing community members (buyers/commissioners must have a site account). Snugzi may only be designed without MYO by staff members and officially designated and selected artists (known as 'Official Artists'), who have their own established limits and guidelines provided by the Snugzi staff team. The sale of Snugzi designs or Adoptables (also known as Adopts) may only be done with permission from Keamuu, resale and retrade of existing official designs are allowed.

Pompi may be openly created and designed, Pompi may be sold as Adoptables for profit but must be uploaded to the masterlist prior before being sold using a free MYO item obtainable in the shop. Similarly a free Pompi MYO item is required to make custom commissions for Pompi species. Remember to upload them to the masterlist so they’re easy to manage.

No part of the Snugzi world, open or closed species, may be used for commercial profit without expressed permission from Keamuu.

Ownership Rights:

When owning a Snugzi you may freely create an identity for your Snugzi, use them for roleplay, fanwork creations, alternative universe including human or other species designs, commission work or create art pieces. You may trade your Snugzi, or resell them for their appraised value*.

You may redesign your Snugzi; redesign rules are fairly flexible, as long as the Snugzi remains recognizable from the original design and uses the proper redesign items. For example:

You may add or remove traits through the use of items.
You may change colours or patterns on the design within reason.
You may change the body type of the design.

*Appraised value is determined by the value shown on the Snugzi Website Masterlist in the characters 'stats' section. This value can only be set by staff and is related to commissioned artwork value and/or adoptable value. All appraisals must go through a Discord ticket in order to update an appraised value.

You are NOT permitted to:

Use your Snugzi for NFTs or generative/image creating AI.
Use your Snugzi to promote hate or harmful ideologies.
Create NSFW, sexual or explicit content depicting feral and/or underraged characters.
Sell your Snugzi for more than the appraised value or worth.
Claim you are an owner, staff member or creator of the species.
Co-owned a Snugzi, co-ownership is not recognized by Snugzi staff; any issues that arise from co-ownership will not be assisted with or resolved by staff.
Claim a design as your own when you are not the designer or steal or copy others’ designs for your own Snugzi.

How to Get a Snugzi:

Adoptable Sales

Snugzi designs can be sold by Staff and selected Official Artists; they may be sold in Flatsales (fixed price), Auctions (bidding), OTAs (offering money, art, designs, characters), or Raffles. Staff and Official Artists may also host giveaways where designs will be raffled off for free, and events or contests where designs may be won.

Personal work may be included for appraisals; proof of a minimum of 3 comparable commissions sold that match the style of personal pieces will be needed to add personal work to appraisals.
Snugzi won from giveaways, events, or contests have no value, and can not be sold unless appraised for commissioned work and sold for that total value.
Snugzi purchased through OTA, Auctions, Flatsales, will have that value as their base value and cannot be sold for more than that value unless value is added by appraisal of commissioned work.

MYOs

MYOs can be obtained using the species currencies (Plipz or Droplitz). You can get obtain for free through foraging, trading, gifts, events, and prompts.
You may obtain an MYO through trading or receiving a gift from another member.

MYOs cannot be resold for USD or any real life currency. They can be traded for non-currency such as characters, items, commissions.

General Design Rules:

No hateful imagery, references or likeness is tolerated.
Gore is allowed but needs appropriate warnings on the Masterlist where applicable, art depicting gore needs to be kept within the relevant channels on Discord and properly marked.
Redesigning your character is open as long as the design is still recognizably the original character and you have the needed item(s) relevant to your design changes.
- Note: Re-designs are based on the original design, not any previous redesigns. You will need the relevant item to add back any previously removed traits.

Trading & Selling

Trading Code of Conduct

Snugzis with adult content attached to them cannot be sold/traded to minors, nor can their toyhouse be posted within the server unless the images are appropriately tagged and hidden.
When transferring a Snugzi, you acknowledge that you no longer possess any ownership towards the character, furthermore you cannot enforce rules for the new owner to abide by when transferring. Personal TOS cannot be enforced on Snugzi characters or designs.
When trading a Snugzi with additional one off forms, they must all be traded and or sold together.
Snugzi’s that are based off of non-Snugzi characters may be appraised including the value of the other non-Snugzi characters to the total value of the Snugzi; all forms must be traded together.
Unsolicited offers are not permitted, users found repeatedly sending uninvited offers will face diciplinary actions.
Backing out of trades in which both parties have agreed on and initiated will result in receiving diciplinary action, similarly forcing users to trade back is not permitted. Repeated offences may result in account suspension or termination.
Using personal art to inflate the value of a Snugzi character for the purpose of resale is forbidden. Users found engaging in this behaviour will be suspended from personal art appraisals.

Adopt Sales Code of Conduct

If you have purchased a design, you are required to respond to the seller within 48 hours. If you do not respond to the seller within 48 hours, you will be temporarily suspended from participating in purchasing Snugzi designs. Repeated offences can result in a ban, account suspension or termination. Please ensure you can afford any bids placed regardless of outside factors.
Backing out of adopts is not permitted. Similarly, bids are final. If participating in an auction be sure you can afford your bid. Breaking this rule can result in a ban.
If users are found purchasing an excessive volume of Snugzis within a short period of time, they may be temporarily suspended from participating in purchasing Snugzi designs, or require additional verification to ensure buyer safety.

Trading

You cannot trade or advertise within the Discord server any Snugzi characters that are account bound or on a cooldown.
Trading a Snugzi for a character that has a higher value then the Snugzi themself does not alter the Snugzi’s value in any way.
When trading a Snugzi with an appriased value, the character will retain the appraised value, even in cases where the traded character's value is different, trades do not count as sales.

Selling

A Snugzi’s base value will be directly listed on the site, this is the value they received from initial purchase or commission value. This value will be edited/changed when appraised.
When appraising a Snugzi, please note that only art commissioned directly for real money allows for additional value to be granted, or personal art that has been properly appraised with proof of commission worth. Trading for art does not permit for additional value to be listed.
To appraise a design, proof of the monetary transaction must be provided, such as screenshots of the payment method confirmation message or an email associated with the purchase.
Value cannot be added to the Snugzi unless it has been officially appraised. Individuals caught selling a Snugzi for unappraised/unofficial worth is considered scamming. You should reach out to a staff member or create a report if you suspect a user of attempting to scam or inflate a character's value.
You cannot create a one-off character alongside a Snugzi to sell the one-off and include the Snugzi in that sale.
Snugzis cannot be added to bundles unless the bundle itself does not exceed the value of the Snugzi.

Vouchering

Snugzis can only be vouchered for their total value. This includes base value and any appraised values.
Snugzis without any monetary value cannot be vouchered.
Vouchers need to be approved in the #support-ticket Discord channel prior to posting. Users caught vouchering a Snugzi for higher than their total value will be reprimanded under the scamming rule.

Voiding your Snugzi

If you no longer wish for your Snugzi or other sub species to be valid, you can freely void them as long as you meet the following requirements:

You are the original designer of the Character, or you have permission from the original designer to do so.
You are the current owner of the Character.

Snugzi characters once voided cannot be unvoided until after a cooldown period of one month. Any Snugzi that has been voided will be renamed and tagged on the masterlist as such. Snugzis that have been voided can be freely traded like usual, however they are still only allowed to be sold for their total appraised value if you wish to return them to an official Snugzi in the future. When unvoided a Snugzi will return to their value from before being voided, regardless of any art purchased in the time when they were voided. Anyone found exploiting their voided status to resell the Snugzi for higher prices only to later reinstate them will have their request to do so denied.

Account Binding Your Snugzi

Account binding is an optional feature you can request through a #support-ticket to bind the Snugzi to your account. By doing this, you can no longer trade the Snugzi and it will become tied to your account.

If you request to bind your Snugzi to the account, they will be bound to your account for a minimum of 1 year from the date of your initial request, after this period you are welcome to freely request to unbind them.
Non-voluntary account bound Snugzis cannot be unbound.
Snugzis that have been account bound will keep their value listed on the site and it will remain even if they are unbound in the future.

Copyright Based Characters

Users are not permitted to include copyrighted elements in their Snugzi designs. However, they are allowed to be inspired off of a copyrighted character or intellectual property, but they may not have key elements of the copyright protected source in the design. For example, logos may not be used, or key character designs may not be directly copied into a Snugzi interpretation, but colour schemes and abstracted references are permitted.

Snugzi based off of characters or sources of media that are description based where they do not have an official appearance/design may be closer to the source inspiration design-wise due to descriptions requiring personal interpretation. When submitting a copyright based character (CBC) design for approval the source material that inspired the design must be disclosed.

CBC Designs cannot be sold as adopts, but can be sold or vouchered for any appraised value.

User Raffles

Users can request via #support-ticket to have their own Snugzi related raffles within the server. Raffles will be hosted by the staff team, however users may submit the contents of which will be raffled furthermore, they will be credited as contributing the prizes.

Users may provide the following to be raffled:

MYO slots
At minimum, 3 items or at least $5 USD worth of either currency (5000 Plipz or 5 Droplitz)
Pre-made Snugzi designs

We do not allow customs or art to be raffled at this time. Additionally, anything that is account bound or on cooldown cannot be raffled. The contents of the raffle prizes must be sent to the admin account on site prior to the raffle being posted. Additionally, they can request the prize to have a cooldown and the date that the raffle is posted. However, besides that they are not permitted to request any specific rules that the winner of the raffle must abide by.

Banning & Account Termination

Users who have been banned from the Discord server will be banned from the website as well. Their account will be inaccessible, however any Snugzi that they may own will still be under their ownership.
Users who are banned cannot receive any new Snugzi, however they may request that the Snugzi under their account prior to their termination are traded to other users. This can be done by getting the additional party to create a #support-ticket on Discord and providing proof of the request of transfer, or the banned user can message the Snugzi account on discord to request the transfer of characters.
When a user is banned from the server, discussion about them is strictly prohibited.
A user can send an appeal request by messaging the Snugzi account (quiltzi) on Discord, you will need to send a friend request to the account to do so, all requests are accepted by the account.
Appealing does not guarantee you will be unbanned and the team reserves the right to reject your appeal.

Voluntary Termination

If you no longer wish to have your Snugzi site account, you can request to deactivate your account at any time.
Deactivating your account will remove any ranks you may have, cancels any design updates and cancels any trades, or submissions.
If you wish to reverse this decision, you can make a ticket within the server to request your account be reinstated. This can be done at any time.
